Many Section 69 BNS cases don’t start with romance – they start with trust
Many people think these cases are about broken promises. Courts increasingly examine broken trust.
A promise of marriage is not always the beginning of a Section 69 BNS case.
Very often, trust comes first.
Recent reports from across India involve allegations against individuals who had already established a position of confidence with the complainant.
The accused are alleged to have been police personnel, acquaintances, persons offering assistance, or individuals who had developed a relationship over time.
In another case from Jharkhand, a tuition teacher was convicted for sexually assaulting his student, highlighting how criminal law treats allegations involving abuse of a position of trust very differently from ordinary relationship disputes.
These developments raise an important litigation question.
Does the law examine only the promise that was made?
Or does it also examine the relationship in which that promise was made?
Modern criminal litigation increasingly focuses on the latter.
Courts and investigators often examine:
Was there an existing relationship of trust?
Did the accused occupy a position of authority or influence?
Did the complainant rely upon that trust while making personal decisions?
Was the promise of marriage an independent assurance, or was it reinforced by an existing position of confidence?
These questions frequently become central to the investigation.
Because trust often explains why a complainant believed the representations allegedly made.
The legal principle, however, remains unchanged.
Section 69 BNS is concerned with consent allegedly obtained through deception.
And where that alleged deception is preceded by a relationship of trust, courts are increasingly examining not only what was promised, but also why the promise was believed in the first place.
