A Section 69 BNS case doesn’t always end with one accused
One of the biggest misconceptions about Section 69 BNS cases is that they are always disputes between two individuals.
Increasingly, they are not. One allegation can pull an entire family into criminal litigation.
Recent reports from Jharkhand and Uttar Pradesh involve allegations of sexual exploitation under the promise of marriage where the FIRs are not confined to a single accused. In one case, multiple persons have reportedly been named, while another involves allegations that the complainant was exploited after being induced into the relationship.
This raises an important litigation question.
When does a relationship-based allegation become a case involving a wider criminal conspiracy or collective participation?
Because modern criminal litigation is often examining much more than the promise of marriage itself.
Investigators may ask:
Was only one person involved?
Did others knowingly facilitate the alleged offence?
Were threats, intimidation, or coercion used by family members or associates?
Did anyone help conceal the alleged acts or influence the complainant after the dispute arose?
The answers to these questions can significantly affect the nature of the investigation, the offences invoked, and even the approach to bail.
The practical reality is that not every Section 69 BNS prosecution remains confined to the relationship between two individuals.
As additional allegations emerge, the focus may shift from personal conduct to the role played by others before, during, or after the alleged offence.
The legal principle, however, remains unchanged.
Section 69 BNS is concerned with consent allegedly obtained through deception.
But where the allegations extend beyond a single accused, courts are increasingly required to examine not only what was promised, but also who participated in the alleged deception and to what extent.
