A promise of marriage is often just the beginning of the FIR
The most dangerous legal risk may not be Section 69 BNS itself, but the offences that follow
One allegation.
Multiple offences.
That is becoming the new reality in Section 69 BNS litigation.
Recent reports from across India no longer describe allegations confined to a promise of marriage.
Many FIRs now include allegations of forced abortion, blackmail using intimate photographs, financial fraud, extortion, concealment of identity, kidnapping, criminal intimidation, and even the involvement of multiple accused.
Some cases reportedly arise from relationships that began through Instagram or Facebook.
Others involve allegations against relatives, friends, or persons who allegedly facilitated the relationship.
This reflects an important shift in criminal litigation.
Section 69 BNS is increasingly becoming only one part of a much larger investigation.
Once an FIR is registered, investigators often look beyond the promise of marriage itself.
They examine whether any other offences were allegedly committed during the course of the relationship.
Was there financial exploitation?
Were there threats to circulate private photographs or videos?
Were medical procedures allegedly forced?
Did anyone else assist in the alleged acts?
Was identity concealed to induce consent?
These questions frequently determine the direction of the investigation, the gravity of the offences invoked, and the strategy adopted by both the prosecution and the defence.
The legal principle, however, remains unchanged.
Section 69 BNS addresses consent allegedly obtained through deception.
But modern relationship-driven criminal litigation is increasingly showing that the investigation rarely ends with that allegation alone.
Because once the facts begin to unfold, a relationship case can quickly evolve into a far more complex criminal prosecution.
